1. General Information
1.1 The Auld Romantics is a sole proprietorship based in Perth, Scotland, UK. 1.2 For queries, please contact us at hello@theauldromantics.com.
2. Ordering Process
2.1 All orders are subject to availability and acceptance. 2.2 Once your order is placed, you will receive an email confirmation. This email confirms we have received your order but does not confirm acceptance of the order. 2.3 We reserve the right to cancel orders in cases of error, fraud, or if the product is unavailable.
3. Returns and Refunds
Consumer Right to Cancel
3.1 If you change your mind, you have the right to cancel your order within 14 days of receiving your goods. You must notify us by email at hello@theauldromantics.com to initiate the return process.
Exemptions
3.2 The following items are exempt from returns unless faulty:
Custom or personalized products (e.g., clan tartan designs).
Perishable goods (e.g., seasonal items such as Christmas-specific keepsakes).
Return Conditions
3.3 Returned goods must be in their original condition, unused, and in their original packaging. You are responsible for ensuring the goods are returned safely.
Return Costs
3.4 Unless the item is faulty, you are responsible for return postage costs.
Refund Process
3.5 Refunds will be processed within 14 days of receiving the returned item or proof of return.
4. Faulty or Damaged Items
4.1 If your item arrives faulty or damaged, please contact us within 30 days of receipt with photographic evidence. We will arrange a replacement or refund, including return postage costs.
5. Delivery
5.1 We aim to dispatch orders within the timeframes specified on the product page. However, delays may occur during peak periods. 5.2 Customers are responsible for providing accurate shipping information. We are not liable for delivery issues arising from incorrect details provided.
6. Personalized and Bespoke Products
6.1 Due to the nature of personalized products, slight variations may occur. We ensure the highest quality standards and will rectify errors if they arise due to our fault.
7. Intellectual Property
7.1 All content, including text, images, and designs, is the property of The Auld Romantics and may not be copied, reproduced, or distributed without prior consent.
8. Photography Commissions
Copyright
8.1 The copyright of all photographs taken remains with The Auld Romantics.
Display
8.2 The client agrees to allow The Auld Romantics to display any photographs for promotional purposes, including but not limited to advertising, websites, and social media.
License, Coverage, and Reproduction
8.3 Photographs will be taken at the photographer's discretion, but every effort will be made to meet the client's requirements. 8.4 The photographer has artistic license regarding poses, locations, and other elements of the shoot. 8.5 The client understands that the shoot may be subject to environmental conditions and agrees to flexibility in timing and location changes.
Prices
8.6 All prices are as stated at the time of booking. Additional goods not specified at booking will be charged as per current rates.
Payments
8.7 A non-refundable booking fee of 40% is required to confirm the booking. The balance must be paid at least 7 days prior to the shoot.
Force Majeure
8.8 The photographer is not liable for cancellations or delays caused by circumstances beyond their control, including weather, illness, or natural disasters. In such cases, refunds will be limited to work completed or deposits paid.
Cancellation
8.9 If the client cancels within 48 hours of the shoot, a new booking fee will be required. Rescheduling may be arranged with at least 48 hours’ notice.
Personal Accident
8.10 The photographer is not liable for personal accidents occurring during the shoot.
9. Privacy Policy
9.1 Your privacy is important to us. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal data.
10. Limitation of Liability
10.1 We are not liable for any loss or damage caused by circumstances beyond our reasonable control, including but not limited to postal delays, natural disasters, or third-party delivery issues.
11. Governing Law
11.1 These terms and conditions are governed by and construed in accordance with the laws of Scotland. Any disputes arising will be subject to the exclusive jurisdiction of the Scottish courts.
